Terms & Conditions

A. Acceptance include terms and condition mentioned below and also includes shipping policy, Copyright policy & Privacy Policy

1. Seller means and include scalearts.in. Buyer means and includes entity/person/company etc. who intends to purchase.

2. By checking the checkbox, you confirm that you have read and agreed to our Terms and Conditions while ordering from our website. An unboxing video is mandatory for any claims related to product returns or delivery issues.

Important Notice on Returns:

Returns are only accepted in the following cases:

The product is received damaged,

The product has a manufacturing defect, or

A wrong item was delivered.

It is important to communicate such issues via email along with the unboxing video and complete order details within 24 hours from the delivery. Please note that return or replacement requests sent over WhatsApp or social media will not be accepted.

In all cases, a clear and continuous unboxing video (from showing the label on the package opening to product inspection) is mandatory. Claims without this video will not be entertained.

Failure to provide an unboxing video on email within 24 hours from the delivery implies that the product was delivered securely and you have no objections regarding its quality. Claims related to damages, defects, or other issues without an unboxing video will not be entertained.

3. Intended age for the products listed on the individual product page, Most of the products are intended for 14+ age group until mentioned otherwise. By accepting terms and conditions / checking the checkbox, you accept that you are of the age of 14 years or above.

4. By checking/clicking on checkbox it is confirmed that you have read the product description carefully and you accept the condition, size and other details mentioned in the product description page.

 

    B.  Acceptance of order

    1.By placing an order on the seller’s website, the buyer acknowledges that acceptance of the order is subject to the following terms:

    Upon submission of the purchase order, an order confirmation page will be displayed, and a confirmation email detailing the order specifics, including product details and status, will be sent to the buyer’s registered email address.
    The issuance of the order confirmation page and email does not constitute a binding contract of sale between the buyer and the seller.
    A contract of sale is formed only upon receipt of the full payment (consideration) by the seller. The seller reserves the right to reject or cancel the order.
    Once payment is received, the seller will initiate the processing and dispatch of the order through the available courier services, subject to the terms outlined in the seller’s shipping policy.

    2.The seller reserves the right to cancel any order at their sole discretion, without providing an explanation. In the event of a cancellation, any applicable refunds will be processed to original / source payment mode or via wire transfer within 8-15 bank working days from the date of cancellation.

    Furthermore, any threats, defamatory statements, or attempts to malign the seller’s reputation through any mode of communication—including but not limited to social media, forums, public platforms, or communication groups—will be deemed acts of defamation. Such actions may result in the initiation of legal proceedings against the offending party in accordance with applicable laws.

    3. Prepaid Orders Policy

    All orders placed on our website are strictly prepaid. By completing the payment, the customer acknowledges and agrees to the following:

    • Orders are processed only after successful payment confirmation.
    • Dispatch and delivery timelines are indicative and may vary due to operational, logistical, or external factors beyond our control.
    • Delays in dispatch or delivery do not constitute grounds for cancellation or refund once the order is confirmed.
    • For pre-order products, timelines are clearly specified on the product page. Such orders are non-cancellable and non-refundable, unless explicitly stated otherwise.
    • The company shall not be held liable for any perceived “blocking of funds” during the order fulfillment period.


      C.  Prices

      1. Product Price/MRP:
      The price displayed on the product description page represents the actual price or Maximum Retail Price (MRP) of the product. This final price includes all applicable taxes and standard shipping charges, unless stated otherwise.

      2. Pricing Above MRP:
      In cases where the selling price exceeds the MRP, the additional amount represents extra charges for special packaging and shipping.

      3. Pre-Order Pricing:
      Prices for pre-ordered products are subject to change based on availability and final landing costs.
      If there is any change in price or MRP after a pre-order has been placed, the seller will notify the buyer via email with the updated pricing details.

      4. Pricing Errors and Zero-Value Listings 

      In some cases, if a product price is displayed as ₹0 (zero), it indicates a technical or listing error. Such listings may also be intended solely for internal development or testing purposes by our team. These listings are not meant for customer purchases. Any orders placed for such zero-value products will be automatically canceled without prior notice or explanation. We reserve the right to reject such orders at our sole discretion.

      5. Invoice & Tax Calculations Disclaimer
      The automated order confirmation email, checkout page invoice, or any preliminary calculation displayed after placing an order shall not be treated as the final tax invoice. These documents are generated automatically for confirmation purposes only.

      The final tax invoice will be issued and included with the package at the time of dispatch. Customers may also request a copy of the final tax invoice once the order has been processed. Please note that only the final tax invoice should be relied upon for accurate tax calculations, GST details, and accounting purposes.

      6. Right to Modify Prices Without Prior Notice

      We reserve the absolute right to revise, update, or modify product prices, MRPs, handling charges, or any related pricing components at any time without prior notice, in accordance with applicable laws, regulatory requirements, market conditions, or changes in import duties and logistics costs.
      Any such changes will be reflected on the website as soon as updated and will apply to all future orders. Customers are advised to review prices at the time of purchase, as price modifications will not be communicated individually unless explicitly required under law.


        D. Description of Goods

        1. Definition of Goods
        Goods refer to products/items displayed on the seller’s website for sale, unless otherwise specified in the product description or catalogue images.

        2. Color Disclaimer
        Scale Arts In makes every effort to display product colors as accurately as possible on its website. However, variations in color may occur due to differences in color output from devices such as mobile phones, CRT monitors, TFT panels, and LED screens. The seller does not guarantee that the colors viewed by the buyer will perfectly match the delivered product. To the extent permitted by applicable law, the seller disclaims all warranties, express or implied, regarding the accuracy of the color representation or other information contained on scalearts.in.

        3. Product Availability
        In rare cases, a product may become unavailable before the buyer completes checkout. If this occurs, the buyer will be notified during the checkout process. All items are subject to availability. If the seller, for any unforeseen reason, cannot complete an order after processing (e.g., stock shortages, payment issues, product defects), the seller reserves the right to cancel the order. The buyer will be notified via official email, and no substitute products will be provided without the buyer’s consent.

        4. Product Imperfections
        These products are miniature scale model collectibles designed to closely resemble actual vehicles. Due to their small scale, minor imperfections, such as uneven gaps, paint blemishes, surface marks or slight irregularities, may exist. Requests for returns based on such minor imperfections will not be accepted.

        5. Opening Parts Disclaimer
        For models with opening parts (such as doors, bonnets, or trunks), due to manufacturing limitations, some parts may require external support to remain open. In some cases, doors or other components may feel loose, flimsy, or may not shut perfectly. These are not considered defects.

        Additionally, especially in smaller scale models with opening features, uneven panel gaps may be present, and some parts may require support to stay open. Such characteristics are inherent to the manufacturing process at this scale and do not qualify as defects.

        6. Product Handling

        Collectible models are delicate, precision-manufactured items intended for display purposes only. By purchasing, the buyer expressly acknowledges that such products require careful handling. Any damage arising from improper handling, misuse, environmental exposure, or post-delivery intervention shall be deemed the sole responsibility of the buyer and is not covered under any return, replacement, or refund policy.

        i. Evidentiary Requirement for Damage Claims

        All claims pertaining to damage, defect, or discrepancy must be supported by a continuous, unedited unboxing video recorded at the time of first opening of the sealed parcel, in accordance with the prescribed policy. This video shall serve as the sole and binding evidence for determining the condition of the product at the time of delivery.

        ii. Mixed Damage and Post-Delivery Liability Clause

        In scenarios where:

        • A portion of the claimed damage is clearly visible and substantiated in the valid unboxing video; and
        • Additional damage(s) are either (a) not visible, not verifiable, or not present in the unboxing video, or (b) attributable to handling, usage, or any event occurring after delivery,

        such additional damage(s) shall be conclusively presumed to have occurred post-delivery and shall fall outside the scope of seller liability.

        iii. Conditional Return and Refund Adjustment

        In such mixed-damage cases, if the seller, at its sole discretion, agrees to accept a return (in full or in part), the following shall apply:

        • The return shall be treated as a partially valid claim.
        • A proportionate deduction shall be applied to the refund amount, commensurate with the nature, extent, and severity of the post-delivery damage identified during inspection.
        • Such deduction may include, but is not limited to, diminution in product value, repair feasibility, resale impact, and handling-induced defects.

        iv Reservation of Rights

        The seller reserves the absolute and final right to:

        • Assess the condition of the returned product,
        • Determine the classification of damages (pre-delivery vs post-delivery), and
        • Quantify the applicable deduction in refund value.

        The buyer expressly agrees that such assessment shall be final, binding, and not subject to dispute, except as may be required under applicable law.

         

        7. Product Quality and Brand Research
        Buyers are advised to research product brands and their quality before making a purchase. The seller does not accept return requests based on dissatisfaction with build quality, as the seller acts as a retail portal and is not the manufacturer. For example, budget brands such as Motormax, Maisto, and Bburago may not match the quality of premium brands like Norev, Minichamps, GT Spirit, or Kyosho. Buyers should study the product’s quality to avoid disappointment.

        8. Wheel Assembly Disclaimer
        Many models (approximately 90%) feature press-fit wheel assemblies. If a wheel is found out of place, it can be easily fixed by pressing it back into position. Return or replacement requests for such cases will not be entertained.

        Additionally, the products sold are collectible scale models intended for collection purposes only and do not possess any play value. As such, the wheels are not designed to move freely. Complaints such as "wheels are not rolling," "wheels do not roll correctly," "wheels are not aligned properly," or similar issues will not be accepted as valid grounds for return or replacement.

         

          E. Packaging Guarantee Notice:

          1. Packaging and Shipping Disclaimer
          The seller makes every effort to ensure that products are securely packaged for safe delivery. However, the seller does not guarantee the condition of outer packaging, acrylic cases, or any non-essential packaging elements unless explicitly specified for carded models or otherwise noted in the product description. Despite all precautions, damages may occur during transit, intake processes, or due to manufacturer-provided packaging methods. 

          2. The seller is not liable for any damage to the outer packaging or acrylic cases caused during shipping, handling, or logistics. Scratches, scuffs, or other minor cosmetic imperfections on acrylic cases that do not impact the functionality or integrity of the product are considered normal and are not eligible for return or replacement.

          3. Acknowledgment of Risks During Transit The buyer acknowledges that shipping and handling processes involve risks, including potential wear and tear on packaging. While the seller strives to minimize these risks by securely packing all items, responsibility for damage to external packaging materials is assumed by the buyer upon shipping.

          4. Return Policy on Packaging Issues Requests for returns or replacements due to cosmetic damage to outer packaging or acrylic cases will not be entertained.

          5. Special Packaging Requests
          Buyers seeking enhanced or protective packaging (e.g., for gift purposes) should contact the seller before placing an order. Such requests may incur additional charges and are subject to availability.

           

            F. Shipping

            1. Shipping Charges
            All delivery charges are to be paid by the buyer, as indicated on the product description page. If a product shows "Free Shipping," no shipping charges will be incurred.

            2. Delivery Address

            i. Delivery will be made to the address specified by the buyer at the time of placing the order.

            ii. If the buyer fails to provide the correct or complete address during the order placement and requests an address change after the package has been dispatched:

            The address cannot be changed at this point.

            a. If the courier fails to deliver due to the incorrect address, the seller will not be held responsible.

            b. If the package is returned to the seller, the buyer will need to pay additional charges for reattempting delivery.

            c. If the buyer chooses to cancel the order after the return, the refund will be processed after deducting: The shipping charges + Insurance amount (approx. 2%-5% of the order value) paid by the seller for delivery from the warehouse to the provided address. Plus return charges for sending the package back to the seller.

             

            3. Contact Details

            i. To ensure smooth delivery of your order, please make sure that the mobile number provided is correct, active, accessible, issued in India, and capable of receiving OTPs. This verification step is crucial for successful delivery.

            ii. If the buyer is unavailable to accept the order at the time of delivery, or if any delivery-related information (such as address, pin code, or contact number) is incorrect:

            -The shipment may be returned to Scale Arts In.

            -In such cases, the buyer will be responsible for paying additional shipping charges to re-ship the order.

            -Alternatively, if the buyer chooses to cancel the order upon the return, the shipping charges + Insurance amount (approx. 2%-5% of the order value) (both from Scale Arts In. warehouse to the buyer’s address and from the buyer’s address back to Scale Arts In. warehouse) will be deducted from the refund amount.

            iii. Once the shipment is dispatched from Scale Arts In., no changes can be made to the contact number, address, or any other delivery-related details.

             

            4. Orders on Behalf of Someone or for Gifting

            When placing an order on behalf of someone else or to gift it to someone, you must provide the correct contact details of the recipient, including their mobile number for delivery purposes.

            Please note that the automated communication, including tracking and delivery updates, will be sent to the contact number provided for delivery.

            The seller cannot be held responsible for complaints related to the recipient being aware of the delivery or any surprise being ruined, nor for any issues arising from breaches of privacy policy due to this communication.

             

            5. Delivery Timeline
            Once the order is confirmed, delivery may take between 7 to 28 working days, depending on the buyer’s location and the availability of delivery partners (excluding pre-order listings or unless otherwise stated).
            The seller will make every effort to deliver within the timeline and will endeavor to deliver the goods within 7 to 12 working days from order confirmation wherever possible.

             

            6. Delivery Estimates
            All delivery times or dates provided are estimates given in good faith and are not guaranteed or binding as contractual conditions or warranties.

             

            7. Time-Sensitive Orders
            If the goods are required for a specific event or occasion, it is strongly advised to place the order well in advance.

            i. Example: For gifts or time-specific events, order at least 15–21 working days in advance.

            ii. No return requests or complaints will be accepted for cases such as, "The item was intended as a gift, but it arrived late, and we no longer need it," or similar scenarios.

             

            8. Variable Shipping Costs
            In certain cases, delivery charges may vary based on the type of product ordered and the courier service available for the delivery location.

             

            9. Transfer of Risk
            Once the goods are delivered to the specified address, the risk in the goods passes to the buyer. The buyer is solely responsible for the custody, care, and maintenance of the goods thereafter.


              G. International Shipping

              1.The Jurisdiction of the seller to ship worldwide is not limited and restricted to one place and can ship the product worldwide, hence for international shipping interested buyer can enquire about product on “info@scaleartsin.com” and buyer can get reply within 24-48 hours.

                 For international order seller only accepts “PayPal” payment platform.


                H. Pre-Order Policy

                1. Approximate Timeframe:

                The time provided in the pre-order listing is approximate and subject to change. Delays may occur due to production, shipping, or other unforeseen circumstances, act of god etc. We will do our best to keep you informed of any changes to the estimated time-frame.

                2. No Cancellation Policy:

                It is assumed that buyer have reviewed all product details before confirming order. Hence once a pre-order is placed, it cannot be canceled.

                3. No Refund Policy:

                By placing a pre-order, buyer acknowledge and accept that the purchase is final hence seller is not bound to refunds for pre-orders under any circumstances.

                4. Price Adjustment Rights:

                Scale Arts In. reserves the right to change prices for pre-order items. In the event of a price change, the new price will apply to all pre-orders, regardless of when they were placed.

                5. Order Cancellation by Scale Arts In.:

                Scale Arts In.  reserve the right to cancel pre-orders for various reasons, including but not limited to insufficient stock, unforeseen production issues, or discontinuation of the product. In such cases full refund will be processed.

                6. Dispute Resolution:

                Scale Arts In. reserves the exclusive right to resolve any pre-order issues through official communication channels.


                I. Legal Action Against Threats, Defamation, and Misconduct

                 

                1. Defamation and Threats

                Any threats whether verbal, written, or digital including statements of intent to defame Scale Arts In. via social media, blogs, forums, YouTube, review platforms, or any public channel, will be considered a serious offense.

                Any defamatory statements or attempts to malign the reputation of Scale Arts In., its products, services, or personnel will be treated as willful damage to the brand image and goodwill of the company.

                Such actions will attract appropriate legal proceedings including, but not limited to, criminal and civil action to protect the company’s business interests and reputation.

                2. Misconduct and Abusive Communication

                Any inappropriate behavior including, but not limited to, the use of abusive, threatening, disrespectful, or foul language during any form of communication (email, phone, WhatsApp, etc.) with the authorized staff or representatives of Scale Arts In. will result in:

                Immediate and automatic rejection of any complaint or request,

                Suspension or blocking of the customer from future transactions,

                Potential legal consequences depending on the nature of the communication.

                3. False Allegations and Chargebacks

                Filing false complaints, issuing threats of baseless legal or social media action, or initiating false chargebacks through payment gateways or banks without genuine basis will be considered an attempt to defraud and harass the seller.

                Scale Arts In. reserves the right to initiate recovery and legal proceedings, including but not limited to financial damages, legal costs, and recovery of product value.

                4. Policy Agreement via Order Placement

                By placing an order or pre-order through any official channel of Scale Arts In. - including our website, WhatsApp, Telegram, Instagram, email, or any verified social media platform - you agree to be bound by all terms and conditions outlined in this policy.

                Orders placed through unauthorized resellers, drop-shippers, or individuals not officially affiliated with Scale Arts In. are not the responsibility of the company. We will not be liable for any issues arising from such third-party transactions.

                5. False Reviews or Misleading Feedback

                Any deliberate attempt to post fake reviews, spread misinformation, or mislead other customers about Scale Arts In., whether on social media, marketplaces, or public platforms, will be considered as a direct attempt to harm the business.

                Legal remedies including notices, takedown requests, and damage recovery actions will be pursued without prior notice.

                6. Right to Refuse Service

                Scale Arts In. reserves the full right to refuse service or cancel any order without explanation if the customer is found in violation of any part of this policy or engages in behavior deemed unethical, threatening, or damaging to the company.

                7. Third-Party Involvement Clause

                No third-party individual, advocate, intermediary, or representative shall be entertained in any customer support, dispute, or claim unless legally appointed and officially documented.

                Any attempt to involve third parties - including but not limited to influencers, agents, lawyers (without legal representation documentation), or online communities - to threaten, harass, or pressure Scale Arts In. into unlawful refunds, cancellations, or damages will be considered an act of coercion.

                Such actions may result in the immediate suspension of communication, cancellation of orders, and legal steps for intimidation, blackmail, or public defamation.

                J. Product Size Disclaimer:

However, it is important to acknowledge that the actual size of the product may vary slightly, and it may be either slightly larger or smaller than the indicated size.

                K. Resolution Timeline Notice:

                Our resolution procedure takes proper channel to escalate the matter and timeline may vary, with a minimum duration of 7 working days and a maximum of 45 working days. Hence your cooperation is advisable. we work diligently to provide you with transparent information about the issue and the best possible resolution.
                Your understanding and adherence to these timelines contribute to a smoother resolution process.


                L. Professional Conduct and Communication

                At Scale Arts In., we are dedicated to providing a positive and respectful shopping experience for all our customers. We value open and honest communication and will make every effort to address any issues or concerns related to your transactions promptly and professionally.

                i. Professional Conduct:
                Users are expected to communicate in a courteous and professional manner. The use of obscene words, offensive, disrespectful, or vulgar language is strictly prohibited and may be liable to attract penalty and other legal provisions.
                 
                ii. Logical Communication:
                Users are encouraged to engage in clear and logical communication. Avoid posting content that is intentionally misleading, nonsensical, or lacks logical coherence.
                 

                b. Code of Conduct:

                i. Respectful Communication:
                We expect all interactions with our customer support team, vendors, and fellow customers to be conducted with respect and courtesy. The use of obscene words, foul language, derogatory remarks, or offensive language is not tolerated and may result in the termination of our support.


                ii. Professionalism:

                We take pride in maintaining a high standard of professionalism in all our communications. We encourage you to express your concerns or inquiries in a respectful and constructive manner, and we will respond in kind.

                iii. 

                Scale Arts In reserves the right to refuse service or discontinue communication with customers who engage in abusive, threatening, or disrespectful conduct toward our staff.

                c. Consequences for Violation:

                i. Violation of these guidelines may result in the removal of content, account suspension, or termination. If obscene words or inappropriate language are used in any form of communication, we reserve the right to terminate the communication immediately and may refuse to provide further assistance for any issues.

                ii. Our customer support team will review reported content and take appropriate action based on the severity of the violation.

                d. Communication through right channels:

                i. Mandatory Email Communication: All communication regarding orders, disputes, or requests (excluding new product inquiries) must be communicated through registered email only. 

                ii. Use of Registered Email ID: Please ensure that all communication is made  using the registered email ID to an email address which is mentioned on our website or the email which was used at the time of placing the order.

                iii. Third-Party Communication: Any correspondence made from any alternate  email id or any other mean of communication will be considered as third-party communication.

                iv. No Obligation to Respond: We are not bound /obligated to respond to any emails, requests, queries, or disputes which is made from any unregistered or third-party email address.

                e. Explanation of the Issue:

                i. Order ID Requirement: When submitting the unboxing video or communicating about an order, please ensure the correct order ID is included in the subject line.

                ii. Detailed Issue Description: Clearly explain the issue in the body of your email, providing as much detail as possible to help us understand and address your concern effectively.

                iii. Attach Relevant Photos or Videos: Along with the unboxing video. include additional clear photos or videos illustrating the issue. This helps us expedite the resolution process.

                 

                M. Resale and Price Manipulation Restriction Policy

                At www.scalearts.in, we are committed to providing collectors and enthusiasts with high-quality, authentic model car collectibles. To maintain the integrity of our brand, we have established the following policy regarding the resale and pricing of products purchased from our website.

                1. Personal Use Only

                All products sold on www.scalearts.in are strictly intended for personal use and collection purposes. Purchases made through our website must not be resold for commercial purposes unless explicitly authorized in writing by Scale Arts In.

                2. Prohibition of Unauthorized Resale

                a. Buyers are not allowed to resell, redistribute, or commercially trade any product purchased from www.scalearts.in without prior written approval.

                b. Selling our products at a price lower or higher than our listed prices on any online or offline platform (including marketplaces like Amazon, Flipkart, Instagram, WhatsApp, or local stores) is strictly prohibited.

                c. Any individual or business found engaging in unauthorized resale will face permanent blacklisting, order cancellations, and potential legal action.

                3. Bulk Order Restrictions

                To prevent unauthorized resellers from manipulating pricing, we enforce the following bulk order restrictions:

                a. Maximum Purchase Limit: Buyers are allowed to purchase a maximum of 2 units per model.

                b. Orders suspected of being placed for resale purposes may be canceled or flagged for manual review.

                c. Multiple orders from the same buyer for the same item attempting to bypass quantity limits will be automatically canceled and buyer will face permanent blacklisting.

                4. Consequences of Violating This Policy

                i. Consequences of Violating This Policy
                If any individual, business, or entity is found violating this policy, Scale Arts In. reserves the right to take the following actions:

                a. Cancel any suspicious orders without notice.
                b. Blacklist the buyer, preventing future purchases from our website.
                c. Report the unauthorized resale activity to e-commerce platforms or relevant authorities for removal or action.
                d. Take legal action under applicable Indian laws if resale and price manipulation result in reputational or financial damage to our brand.

                ii. Legal Action Against Unauthorized Resale & Price Manipulation
                We take our brand reputation and pricing integrity seriously. If a buyer or entity is found engaging in unauthorized resale or price manipulation that negatively impacts our business, we may pursue legal action, which includes but is not limited to:

                a. Cease & Desist Notice: A formal legal notice demanding the individual or business to stop unauthorized resale and remove any listings.
                b. Defamation & Brand Damage Claims: If the resale activity misleads customers or damages our brand image, we may pursue legal claims under Indian defamation laws.
                c. Unfair Trade Practices Complaint: We may file a complaint under the Consumer Protection Act, 2019, citing unfair trade practices if unauthorized sellers intentionally distort market prices.
                d. Trademark Violation Action: If an unauthorized reseller falsely claims to be affiliated with us, we may take legal action under the Trade Marks Act, 1999 for misusing our brand name.


                5. Reporting Violations

                If you come across any unauthorized resellers selling our products at manipulated prices, please report them to us at legal@scaleartsin.com / scaleartsin@gmail.com with supporting details.
